* Radcliffe School Atrocity on Dalit Student
CBD Belapur 03.08.2023 : On 3rd August 2023 Demonstration Under Protest was held by Bharat Rashtra Samithi (BRS) before the office of Konkan Divisional Commissioner, CBD Belapur, Navi Mumbai for the failure of Central and State Governments to Protect the Fundamental Rights of a Girl Student (Name with-held to protect the identity) aged about 10 years old belonging to the Scheduled Caste studying in Class IV D Division with Roll No. 13 in Radcliffe School, Ulwe, Navi Mumbai for sending the said student to her home and not allowing her to attend the school till the Fees are paid thus Wrongfully Restraining and depriving the Education as guaranteed Under Article 21A of the Constitution of India by the School Management that is offenses punishable U/s 341, 34 IPC r/w 3(2)(va), 6 of The SC & ST (POA) Act, 1989 as amended.
Whereas Our Prime Minister said “BETI BACHAV BETI PADAO” but in reality it is not being implemented by the State and Central Governments under the rule of BJP.
In many instances we have witnessed students were made to stand on benches or outside the classrooms by the Private Schools and colleges as punishment for delayed payment of fees and some instances students were handed over Leaving Certificates. These Harassment of Private School Management must be stopped immediately.
BRS Delegation presented Memorandum in the Office of The Konkan Divisional Commissioner with Demands of :
1) Take necessary action against the RADCLIFFE School Management immediately.
2) Direct RADCLIFFE School Management immediately to allow the student/s to attend classes and stop harassment as stated above.
3) Issue circulars to all private schools in under your jurisdiction to stop all type of punishments / harassment to the students for the delayed fees or any type/s of payment.
BRS further presented another Memorandum with demand to implement The SC & ST Orders (Amendment) Act, 1976 so that SC/STs residing in Maharashtra State on or before 18.09.1976 can be issued Caste Certificates and become eligible for the benefits in the Maharashtra State, also demanded that persons belonging to DT, NT, OBC and SBC residing in Maharashtra State on or before 18.09.1976 must also be issued Caste Certificates by introducing Ordinance for the amendment of The Maharashtra Scheduled Castes, De-Notified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes And Special Backward Category (Regulation Of Issuance And Verification Of) Caste Certificate Rules, 2012.
BRS Further demanded to provide Reservation to all DT/NT/OBC/SBC/SC/STs residing in the Maharashtra state for not less than 7 years instead of the dates mentioned above by introducing Ordinance as stated above.
