Criminal law cannot be ignored ; SC/ST Atrocity FIR Registered

 

Korutla, October 19: On Sunday, 19th October 2025, Metpally Sub Divisional Police Officer (SDPO) DSP Adduri Ramulu initiated investigation by spot inspection of the wrongfully occupied agricultural land of a Dalit farmer in RamaRaoPalle village under the limits of Peddapur revenue village of Metpally mandal, Jagtial district.

Going into details – for the past few years, there is land in survey No. 478/A/2 in the name of a physically disabled farmer Baddy Hemant Kumar caste SC-Mala native of RamaRaoPalle village, who is based in Mumbai region for the past few years, so taking advantage of the absence of the victim in the village, four people named Latifa, Sheikh Jani, Narmada and Ravi Babu wrongfully occupied that land. They built a hotel there under in the name of "Latifa Cool drinks" without proper documents.

Without any documents or permission, they also took the help of electricity officials with the support of influential local politicians with muscle power. The victim, Baddy Hemant Kumar, came to know about the matter and told the land grabbers that land belonged to him, Give rent or vacate the land. Initially, the land grabbers agreed to give rent but finally changed their minds and said, “We will not give rent” and “We will vacate the land as well.” The police refused to register the crime upon the farmer’s complaint citing, “the matter is of civil in nature”.

Having no other option victim pattadar filed Private Complaint through an advocate from Korutla town namely Baddi Narsaiah in the Hon’ble JMFC Court at Korutla, who made strong argument in the Hon’ble Court  by stating that “property matters both Civil and Criminal Nature are involved hence Criminal law must be set into motion in the interest of justice and the provisions of Criminal law cannot be set aside for also being in Civil in nature. Hon’ble Supreme Court of India in the matter of Syed Askari hadi Ali Augustine Imam & ANR v/s State (Delhi Admn.) & ANR in Criminal Appeal No. 416 of 2009 stated in the 15th Para (Page No. 24) that “As noticed by several decisions of this Court, including two Constitution Bench Decisions, primacy has to be given to a criminal case”.

Being impressed with these arguments Hon’ble Court directed SHO Korutla Police Station to register the crime, hence FIR No. 377/2025 was registered under the provisions of IPC and the SC/ST Atrocities Act. DSP Ramulu video recorded the statement of the victim in the presence of Circle Inspector (CI) B. Suresh Babu, Sub Inspector (SI) P. Ramachandram, Writer Venu Gopal, SDPO Official Mahesh, Ramaraopalle Panchayat Secretary Soujanya and other police, Revenue personnel/officials.

Seeing all this... the Dalit farmer, who had been fighting for justice, finally got hope that his wrongfully occupied land would be returned to him.
